Obscene youth laws, which take precedence over the Penal Code, establish laws concerning the age of consent for certain prefectures. In some cases, sexual activity with people under the age of 15 is illegal, in others the age is 18. In these prefectures, sexual activity with a person under the age of consent can carry a prison sentence of up to five years. Although rare, in some prefectures, even hugging or holding a minor`s hand can be illegal. With the passage of the Tackling Violent Crime Act in 2008, the age of consent in Canada was raised from 14 to 16. It was the first time since 1892 that the age had been raised. The law applies to all forms of sexual activity and was developed with the aim of deterring online predators. The law provides for a “close to age” exception. Therefore, 14- and 15-year-olds can legally consent to someone who is less than five years older than them, and 12- and 13-year-olds can accept a partner if the partner is less than two years older than them.

There must be no relationship of authority, dependency or exploitation of the younger person for consent to be valid. According to article 227-25 of the Penal Code, the age of consent in France is generally 15 and 18 years if the sexual act is performed with a parent or a person who has “legal or factual authority” over the minor participant. Legal rape (or its local equivalent) is punishable by up to five years in prison and a fine of €75,000 (€83,226). The law was only recently passed in April 2018 following an outcry over two men accused of having sex with 11-year-old girls. The French government has decided to set the age at 13 or 15. The ten French territories have also set their age of consent at 15. The France has a Romeo and Juliet clause that eliminates liability if a person under the age of 15 has sex with someone who is within five years of their age. Sexual relations with minors under the age of 14 (for those over the age of 18)[28] are equivalent to legal rape and are legally defined in Article 217-A of the Brazilian Penal Code as “rape of a vulnerable person” (Portuguese: Estupro de vulnerável) with a prison sentence of 8 to 15 years. [29] The Prevention and Punishment of Prostitution Act 1996 regulates gratuitous sexual activity with partners under the age of 18 and is often interpreted by local authorities to include sexual situations involving ordinary persons and not prostitutes. In addition, the Criminal Code Amendment Act, 1997 made it illegal to engage in an “indecent act” with persons under the age of 18, even if that person is a consenting participant.

It is also a “composable” crime, meaning charges can be laid months later if a partner (or relative) regrets it. As a result of these regulations, Thailand has a legal age of consent of 15 years, but an effective age of consent of 18 years. Thailand has no age limit. Civil codes are also approaching the age of consent at the prefecture level (and sometimes municipalities within a prefecture). In Japan, a person must reach the age of 20 to be considered an adult, and parental consent plays an important role in legal issues affecting young people. A person over the age of 21 may engage in sexual activity with a person who is 14 years of age or older but not yet 16 years of age, provided that the younger person`s lack of capacity for sexual self-determination is not exploited. If this is the case, the youngest person would have to file a complaint against the person over the age of 21 so that legal action could be taken. Sexual activities carried out without consent or with violence in any situation are illegal. Many countries, states or territories also have “age-related” exceptions, commonly referred to as “Romeo and Juliet” clauses. These laws may waive any legal liability if all participants in a sexual act are minors (for example, two 16-year-olds). In areas where there are no age-related exceptions, it is possible that a person who has not reached the age of consent may be held responsible for sexual activity with another minor. For example, if a country does not have a Romeo and Juliet clause and its age of consent is 16, two 15-year-olds who voluntarily have sex with each other could both be prosecuted for legal rape.

The age of consent in Peru has changed several times in recent years and has been the subject of political debate. [61] [62] In December 2012, according to a decision of the Peruvian Constitutional Court, it was set at 14, regardless of gender or sexual orientation. [63] Articles 173 and 176-A of the Penal Code prohibit sexual conduct with children under the age of 14. [64] Consensual sexual acts with adolescents between the ages of 14 and 17 are not illegal, although it is prohibited to use deception to gain sexual access to minors under the age of 18 (art. 175). [64] Sexual contact with persons between the ages of 14 and 17 is limited by estupro legislation (art. 363), which defines such contact as unlawful under certain conditions that the perpetrator exploits: in South America, Guyana is the only country where homosexual sexual behaviour by men is illegal. The only countries where the age of consent for same-sex sexual relations is higher than for opposite-sex sexual relations are Paraguay and Suriname.

While most European countries set the age of consent between 16 and 17, several others, including Malta and Vatican City, require young people to be at least 18 years old before having sex legally. The lowest age of consent in Europe is 14, which is true in countries like Austria, Italy, Serbia, Germany and Portugal. Art. 369 clarifies that charges relating to these offences (Articles 361 to 365) may be laid only following a complaint lodged by the minor or his parents, guardian or legal representative.
