Transnet Legal Department

Our primary role is to assist management in identifying legal risks related to labour, regulatory (railway safety authority) and safety issues and addressing them in the best interest of the ISF. The department provides a full range of legal services necessary to meet the organization`s commercial law needs. Given the wide range of activities carried out within TFR and between TFR and its external stakeholders, there is invariably a wide range of agreements and other activities that require legal input. On 31 May 1961, the Union became the Republic of South Africa. In 1981, the government decided that SAR&H should restructure along business lines from a state-owned enterprise to privatization. Later, with the onset of commercial aviation, South African Airways also became part of this vast land, sea and air transportation system. An integral part of the process was a change in the name and image of the organization, which would reflect its new mission as a state-owned economic enterprise. In April 1981, the country`s rail, port, road, air and pipeline operations became known as South African Transport Services (SATS). At the same time, the company was restructured into units and divisions, with an emphasis on localized management. [5] The Legal Succession to the South African Transport Services Act, 1989 transformed South African Transport Services from a government ministry into a public limited company.

[6] On 1 April 1990, after 80 years of state and parliamentary control, SATS was granted company status. Transnet`s former legal chief Kenneth Diedricks and his co-defendants Charles Ernest Pretorius and Refiole Desmond Martins, who are the directors of state-owned contractor Polyzomba, were released on bail of R10,000 each. All legal developments in these disciplines are brought to the attention of management in a timely manner and accompanied in an appropriate manner. The litigation department may appoint external legal representatives vis-à-vis employees if the relevant policy allows it. Due to the size and nature of the organization, a significant number of disputes are generated. The topics have their origins in various departments, Property, Supply Chain Services, Operations, Enterprise Security and Communications, to name a few. General legal advice is also provided on all aspects of the above agreements, including negotiation, review, drafting, amendment, advice on contractual disputes, and advice on the regulatory and compliance regime that applies to them. “On 19 December 2011, Diedricks and the said Managing Director jointly signed and approved the settlement of over R25 million as payment to Polyzomba without consultation, knowledge, approval and signature of TFR`s technical department or senior engineer.” The trial against Carol Aronowitz is currently scheduled for July 12, 2010.

Paul Pemberton`s sentencing is scheduled for February 22, 2008 at 11:00 a.m. before Judge James Cohn in Courtroom 203-E of the United States Courthouse, 299 East Broward Boulevard, Fort Lauderdale, FL. They are also expected to “inform the investigator 14 days before their departure from South Africa and provide him with a complete itinerary of their travel arrangements”. Under federal law, restitution in criminal cases is generally ordered on the basis of losses caused by a defendant and regardless of the defendant`s ability to pay compensation. See 18 U.S.C. 3664(f)(1)(A), which states: “In each production order, the court shall order the restitution of each victim in full of each victim`s losses determined by the court and without regard to the economic circumstances of the accused.” All payments made by the accused go to court and are then distributed among the victims. Any amount owed to a victim is reduced by the amount that the victim recovers for the same loss from another source. If you have any questions about the restitution order, please contact the Federal Office of Probation for the Northern District of Texas.

The litigation function is considered a critical area within Legal, Governance and Compliance Services. In addition, Commercial Stream deals with all intellectual property (“IP”) matters, including registrations and renewals of various forms of intellectual property.
